Terms of Service

1. Service Description

MailCast ("we", "our", "us") provides managed email marketing hosting services. We provision and maintain dedicated virtual private servers (VPS) that run your email platform on your behalf.

2. Account and Billing

By creating an account and subscribing to a plan, you agree to pay the recurring subscription fee associated with your chosen plan. Payments are processed securely through Stripe. You may cancel your subscription at any time through the billing portal. Upon cancellation, your service will remain active until the end of the current billing period, after which your server and all associated data will be permanently deleted.

3. API Keys and Third-Party Services

Our service operates on a Bring Your Own Key (BYOK) model. You are responsible for providing your own API keys from AI providers such as Anthropic, OpenAI, Google, or others. Your API keys are stored on your dedicated server, not in our central database. You are solely responsible for compliance with the terms of service of any third-party AI provider whose API keys you use.

4. Server Access and Data

Each customer receives a dedicated VPS with full isolation from other customers. We access your server only to perform management operations that you initiate through the dashboard (such as configuring channels, updating settings, or restarting the gateway). Your conversations, files, and data remain on your server.

5. Acceptable Use

You agree not to use the service for:

  • Any illegal activity under applicable law
  • Violating the terms of service of any connected AI provider
  • Distributing malware, spam, or harmful content
  • Cryptocurrency mining or other resource-abuse activities
  • Attempting to access other customers' servers or data

We reserve the right to suspend or terminate accounts that violate these terms.

6. Service Availability

We aim to maintain high availability but do not guarantee 100% uptime. Our servers are hosted on Hetzner Cloud infrastructure. We are not responsible for downtime caused by the underlying infrastructure provider, your SMTP provider's outages, or email platform software bugs.

7. Limitation of Liability

The email platform software is open-source and provided as-is. The hosting infrastructure operates automatically but we are not responsible for the behavior, output, or actions of the email platform running on your server. We are not liable for any damages resulting from the use of the service, including but not limited to data loss, business interruption, or email content.

8. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email. Continued use of the service after changes constitutes acceptance of the updated terms.
